Services and Conditions of Use

As part of our service, we agree to provide you with information and other services that we may decide to offer, subject to the terms of this agreement. Upon notice published through the service, we may modify this agreement at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as 'customer' in this agreement.

Website Giveaway Promotion. Participants are agreeing to the following conditions before agreeing to accept the offer:

The website and domain name are free.

The hosting of the website must be hosted with Online Webtraders Ltd, the sponsors of the offer.

To qualify for the free website and domain name, hosting must be completed for 12 months minimum contract, payable in advance, and saving an additional 30% off the quoted prices.

The websites are as seen, and will not carry any stock at the time of installation. The demonstration websites will show sample stock, although customers are accepting the fact that the website will not be installed including any stock. These are samples only on how the website could look when populated with any stock, you may wish to insert.

Although technical service is included, this does not involved modifications in any way. Such modifications would be seen as alterations, and would be quoted for as such.

The service and hosting will start immediately up on payment of the hosting, and no refunds will be given under any circumstances. This is in full accordance with the Distance Selling Regulations in the United Kingdom. This is a service and a customised product. Customised due to the fact that you will be registering a domain name, which we pay on your behalf. Service due to the fact that we will be hosting the website immediately, and registering a domain name on the customer's behalf.

5 templates are included and pre-installed in the package at time of installation.

Online Web Traders Ltd cannot be held responsible for any disruption in the website uptime (99.999%), or cannot be held responsible for any disruption to the following (but not limited to): Loss of business; loss of any revenue; loss of any custom, caused by internet related problems, such as (but not limited to) Acts of God; internet viruses; spyware, etc.

The free website cannot be transferred to any other server, other than that owned by Online Web Traders Ltd, under any circumstances during the first 12 months of contract, and after which time any transfer will be at the owner's own cost.

Limitation Of Liability And Warranty

CUSTOMER AGREES THAT USE OF THE SERVICE IS ENTIRELY AT CUSTOMER'S OWN RISK. SERVICES ARE PROVIDED 'AS IS,' WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE SERVICE, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO THE CUSTOMER AND THE RESULTS OBTAINED THROUGH THE SERVICE. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND 2) ANY WARRANTIES OF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

THIS DISCLAIMER OF LIABILITY APPLIES TO ANY/ALL DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTUOUS BEHAVIOUR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. CUSTOMER SPECIFICALLY ACKNOWLEDGES THE SERVICE IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER CUSTOMERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH CUSTOMER.

NEITHER THE SERVICE NOR ANY OF ITS AGENTS, AFFILIATES OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO GAIN ACCESS TO OR USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY. CUSTOMER HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THE SERVICE.
